An arbitral tribunal has awarded the project company claims in the amount
of approximately EUR 200 million in connection with the construction of the
power plant Walsum 10 in which EVN AG holds an indirect stake of 49% (the
"project company").
In December 2013, EVN AG, as stakeholder in the project company, gave its
consent to the project company for the commencement of comprehensive legal
steps against the general contractor consortium, Hitachi Ltd and Hitachi
Power Europe GmbH, and the filing of an arbitration action against the
consortium. The claims made in the complaint are based on damages suffered
by the project company as a result of the delayed completion of the power
plant Walsum 10 and encompass the pre-financed costs of repair, a flat-rate
compensation for default, additional costs due to delay and further
compensation.
In the arbitral decision delivered today, an arbitral tribunal has awarded
the claimant project company for the construction of the power plant Walsum
10 claims in an amount of approximately EUR 200 million.
The arbitral decision will to a large extent result in a reduction of
acquisition costs for the power plant and is thus currently expected to
have no material effects on the financial results of EVN AG in the 2016/17
financial year.
